Nature of the service
Lopreville Advisory produces written documentation: market studies on Latin American property markets, and technical, documentary opinions on properties identified by the client. The contractual designation of the service is “market study and technical, documentary opinion on a property identified by the client”. The service consists exclusively of the supply of written information. It confers no assistance in carrying out a transaction.
Not an estate agency, and not a crypto-asset service
Lopreville Advisory carries on no activity of intermediation, search, negotiation, sale, letting or property management within the meaning of French law n° 70-9 of 2 January 1970, and holds no carte professionnelle. It does not search for property on a client's behalf, accepts no search mandate, supplies no lists or advertisements of properties for sale, and contacts no seller, agency or intermediary on a client's behalf. It provides no crypto-asset service within the meaning of article L. 54-10-2 of the French Monetary and Financial Code: descriptions of foreign regulatory frameworks are informational and constitute neither advice nor a recommendation of any platform, route or structure.
Independence and remuneration
Lopreville Advisory is remunerated solely by its client. It receives no remuneration, commission, retrocession, gift or benefit of any kind, direct or indirect, from any seller, agency, developer, notary, financial institution, exchange or other intermediary. It never holds funds belonging to a client or a third party, in any form, at any point, including in escrow.
Terms of sale
Each engagement is the subject of a written proposal stating the scope, contents, exclusions, delivery period and a fixed price, before any payment. Prices are in euros. Payment is due in full before production begins. Deliverables are supplied in digital form by email. As a consumer you have a right of withdrawal of fourteen days under article L. 221-18 of the French Consumer Code; where you expressly request that performance begin during that period and expressly acknowledge that you thereby lose that right, the withdrawal right lapses once the digital content has been supplied, in accordance with article L. 221-28, 13°. That consent and that acknowledgment are collected separately from acceptance of these terms, and confirmed to you on a durable medium.
Scope and liability
Deliverables are supplied under an obligation of means, not of result. Information supplied by the client is not independently verified. No property visit, title examination, survey, or cadastral, technical or tax verification is carried out. Deliverables are not legal, tax or investment advice, and are neither a survey nor a valuation; they do not replace the checks that fall to a notary, an architect, a surveyor or a tax adviser, which are identified in each deliverable together with the questions to put to them. Market data is dated and liable to change. The decision to acquire, or not to acquire, rests solely with the client. Nothing in these terms excludes or limits liability where French law does not permit it.
Consumer mediation
In accordance with article L. 612-1 of the French Consumer Code, a consumer client may refer a dispute free of charge to a consumer mediator, after having first raised a written complaint. The mediator's name and contact details will be published here upon appointment, and communicated in the written proposal.
Privacy
The data controller is Lopreville Advisory (contact@lopreville.com). This website sets no cookies and uses no analytics or tracking. Information submitted through the contact form or by email is processed on the basis of pre-contractual steps and contract performance, is used solely to answer you and to produce any deliverable you order, is never sold or shared for marketing, and is retained for the duration of the relationship plus the applicable legal periods. Uruguay benefits from a European Commission adequacy decision (2012/484/EU); in any case, no client document is transferred to any third party without instruction. You may request access, rectification, erasure, restriction or portability, and may lodge a complaint with the CNIL. Write to contact@lopreville.com.
Intellectual property
All content on this site, and every deliverable, is the property of Lopreville Advisory unless otherwise stated. Deliverables are supplied for the personal use of the client who ordered them and may not be redistributed, resold or published. Applicable law
These terms are governed by French law. Nothing here deprives a consumer of the protection afforded by the mandatory provisions of the law of their country of residence.
